Terms of Service – SLEEPwindow Data Sync Portal
Effective Date: June 12, 2026
These Terms of Service govern access to and use of the SLEEPwindow data sync portal (the "Portal"). By accessing or using the Portal through Google authentication, the user agrees to these Terms.
1. Scope of Service
The Portal is a restricted research tool made available exclusively for the SLEEPwindow clinical study conducted by the University of Geneva and Geneva University Hospitals.
Its sole purpose is to authenticate authorized study participants and facilitate the secure collection of selected Google Health / Fitbit data required by the study protocol.
2. Relationship to Study Consent
These Terms govern technical access to and use of the Portal only. They do not replace the separate informed consent forms and study documents governing participation in the SLEEPwindow study.
For research-related matters, including participation, withdrawal, data retention, and scientific use of coded data, the applicable study consent documentation and ethics-approved study framework remain controlling.
3. Eligibility and User Requirements
Access to the Portal is restricted to individuals who have been accepted as participants in the SLEEPwindow study and who are authorized by the study team to use the Portal.
By connecting a Google account and Google Health / Fitbit data through the Portal, the user confirms that the connected account belongs to the user and that the user is authorizing access solely for study participation purposes.
Users must not attempt to impersonate another person, connect accounts belonging to third parties, interfere with Portal operations, bypass security controls, or misuse Google API services through the Portal.
4. Authorization for Data Sync
By connecting Google Health / Fitbit data in the Portal, the user authorizes the Portal to access and import the study-relevant metrics described in the Privacy Policy for the duration of authorized study participation or until access is revoked.
The Portal is intended to collect only the data required for the study and not to modify the user's Google or Fitbit account data.
5. Suspension and Termination
A user may stop using the Portal and revoke Google account access at any time.
The study team may suspend or terminate Portal access where a user is not an eligible participant, where study participation ends, where technical abuse or misuse is detected, or where continued access is no longer necessary for the study.
Termination of Portal access does not automatically require deletion of coded study data already collected where retention remains necessary under the participant consent, ethics approval, or applicable law.
6. Third-Party Services
The Portal relies on third-party services, including Google authentication and Google Health / Fitbit integrations, and on hosting infrastructure operated through Infomaniak in Switzerland.
Availability, performance, or security incidents affecting third-party services may impact the Portal without making the Sponsor responsible for the independent operation of those third-party services.
7. Disclaimer and Liability
The Portal is provided on an "as is" and "as available" basis for research purposes.
While reasonable measures are taken to support reliable operation and secure transmission, uninterrupted availability, perfect synchronization, and complete technical error prevention cannot be guaranteed.
To the maximum extent permitted by applicable Swiss law, the University of Geneva, Geneva University Hospitals, and the study team disclaim liability for temporary outages, synchronization delays, or technical anomalies that do not result from intentional misconduct or mandatory legal obligations.
8. Governing Law
These Terms are governed by the laws of Switzerland and are interpreted in light of the Swiss legal and ethical framework applicable to human research, including oversight by the competent Swiss ethics authorities for the study.
